From the first enquiry
to your agreement.

You can contact us before the other party decides to take part. We will explain how to start, but joint mediation requires the participants’ voluntary agreement.

01

First contact

Briefly describe the subject and stage of the case. You do not need to send documents immediately.

02

Consent and clear ground rules

We explain confidentiality, impartiality, fees, meeting arrangements and the right to withdraw.

03

Discussion and proposals

Each party explains their perspective. The mediator helps structure the issues and explore possible solutions.

04

Agreement or closure

You may resolve all or some issues, or end mediation without a settlement. We explain the documents and next steps.

When is a separate initial conversation needed?

If you fear violence or pressure, or cannot make decisions freely, tell us before a joint session is arranged. Mediation is not appropriate in every situation and does not replace urgent legal protection.

You may work with your legal adviser.

The mediator facilitates the discussion. Your own lawyer can advise on the settlement’s legal and tax consequences and required form. In civil cases, court approval is a separate step.

Legal framework

Questions that
start the conversation.

Legal framework
Does the other party have to agree to mediation?

Yes. Mediation is voluntary. You can ask about the process on your own, but joint discussions require both parties’ consent. Either party may also withdraw.

Does my case have to be in court already?

No. Mediation can begin before a claim is brought to court or while proceedings are underway. How mediation starts and how fees are determined depend on whether the parties approach the mediator themselves or are referred by a court.

Will the mediator decide who is right?

No. The mediator helps the participants talk, clarify the issues in dispute and explore possible solutions. The mediator is neither a judge nor either party’s legal representative. The participants decide what their agreement will say.

What if we do not reach an agreement?

Mediation can end without a settlement. There is no obligation to reach an agreement. Mediation may resolve only some of the disputed issues; for the remaining matters, the parties retain the legal avenues available to them.

How much does mediation cost?

We agree the cost of private mediation before it begins, taking account of the type of case and the planned meetings. Court-referred civil mediation in Poland is subject to fees set by regulation. The Polish State Treasury covers the costs of criminal mediation referred by an authorised body.

Does a mediation settlement have legal effect?

In Polish civil proceedings, a settlement reached before a mediator has the same legal effect as a settlement reached before a court once the court approves it. If the settlement is enforceable through compulsory enforcement, the court approves it by granting an enforcement clause. Not every agreement can replace a judgment or a particular legal form required by law.

Can we meet online?

Yes. We also conduct mediation online. We first agree the meeting format and practical arrangements with the participants. You will need a stable internet connection and a quiet place where you can talk without other people being present.

Are the discussions confidential?

Confidentiality is a basic principle of mediation. In Polish civil proceedings, mediation is not public and participants must keep confidential the facts they learn during mediation, subject to the rules set out in law. We explain the details and any limits relevant to your case before discussions begin.
